Can I get vacation days back if I was sick?
In the US, it depends on your employer's policy: there is no federal rule requiring vacation days to be re-credited when you fall sick, so the deciding factors are whether your company tracks sick leave separately from vacation, what the written policy says about converting booked PTO, and whether a state or city paid-sick-leave law covers the absence. Where sick leave is a separate protected entitlement, as in California and many other jurisdictions, you can generally use sick days instead of vacation days for the sick portion of a trip, usually with prompt notice and, for longer stretches, a doctor's note. Some countries make this a legal right: in Germany, sickness days documented by a medical certificate never count against vacation and are re-credited by law. The practical playbook is the same everywhere: notify your employer as soon as you fall sick (not after you return), see a doctor and get documentation, and request the conversion in writing. Days are re-credited to your balance. The trip does not automatically extend.
The US baseline: policy decides
There is no US federal law on getting vacation days back when illness strikes mid-trip. If a company grants one combined PTO bucket, a sick day on vacation is simply a PTO day, and nothing changes unless the policy says otherwise.
Where vacation and sick leave are separate buckets, the picture improves: most reasonable policies let you reclassify the documented sick portion of a vacation as sick leave, which returns the vacation days to your balance. The policy wording, and how promptly you reported, decides.
Where paid-sick-leave laws help
Dozens of states and cities now mandate paid sick leave as a protected entitlement: California, New York, Washington, and many more. Where such a law applies, sick time is legally usable for illness regardless of where you happen to be, which strengthens the case for converting mid-vacation sick days. TODO: verify the current jurisdiction list before publish.
Two caveats: protected sick leave usually requires timely notice, and employers may request documentation for longer absences within the limits the law sets. Retroactive claims made weeks later, without any notice during the trip, are much weaker.
The playbook: what to do when you fall sick on vacation
The same four steps protect you under almost any policy:
- Notify your employer as soon as you fall sick, during the trip, not after.
- See a doctor and get written documentation of the illness and dates.
- Request the PTO-to-sick conversion in writing, citing the documented days.
- If you cannot travel back as planned, tell your manager before your approved vacation ends.

How other countries handle it: the German rule
Some jurisdictions remove the discretion entirely. In Germany, § 9 of the federal leave act (BUrlG) provides that sickness days documented by a medical certificate do not count against annual leave: The days are re-credited by law, with a certificate required from day one and special notification duties when abroad.
The German rule also illustrates the universal boundary: vacation does not automatically extend. Re-credited days go back into the balance and are requested again later; staying away longer without approval is treated as unauthorized absence. The German version of this article covers the rules in detail.
Why the days come back but the trip does not extend
Almost every system that re-credits sick-on-vacation days shares one rule: the days return to your balance, but your approved absence still ends on the original date. Extending the trip on your own, even with re-credited days available, is an unauthorized absence in most policies.
The clean pattern: return as planned (or get an extension approved), then book the re-credited days later like any new request.
For employers: handle it as a reclassification
On the company side, sick-during-vacation is a correction case: shorten the approved vacation by the documented days, return those days to the vacation balance, and recode the absence as sick leave, traceably, in the record.
A system that knows this case natively saves manual balance edits and arguments: capture the documentation, mark the period, and the re-credit happens automatically with an audit trail. It also keeps sick data confidential, which matters more here than anywhere.
Common mistakes that cost people their days
Most failed conversions fail on process, not policy:
- Reporting the illness only after returning: notify during the trip.
- No documentation: a doctor's visit at the destination is what makes days recoverable.
- Assuming the trip extends automatically: it does not; days are re-credited, not appended.
- Not knowing whether vacation and sick leave are separate buckets before traveling.
US treatment depends on company policy and state/city paid-sick-leave laws, which vary and change. TODO: verify jurisdiction-specific rules before publish. German rule: § 9 BUrlG with § 5 EFZG notification duties. This article explains common US practice at a general level and is not legal advice; state laws and company policies differ, so confirm specifics for your state.
Frequently asked questions
- Can I use sick days instead of vacation days if I get sick on vacation?
- Often yes, where sick leave is a separate entitlement and you gave prompt notice with documentation. In the US the written policy and applicable paid-sick-leave laws decide; in Germany re-crediting is a legal right.
- Do I need a doctor's note for sick days during vacation?
- Practically always: Documentation is what turns vacation days back into sick days. In Germany a certificate is legally required from the first day; US policies commonly require one for conversions.
- Does my vacation extend if I was sick?
- No. Re-credited days go back into your balance and are requested again later. Staying away longer without approval counts as unauthorized absence.
- What if I get sick abroad?
- Notify your employer immediately, see a local doctor, and get written proof of incapacity for work. In Germany you must also share your vacation address and inform your health insurer.
- Who pays while I am sick on vacation?
- Once days are reclassified as sick leave, normal sick pay rules apply: paid sick leave where mandated or granted in the US, statutory continued pay (up to six weeks) in Germany.
